Abstract:
The loss of crown immunity resulting from section 2 of the National Health Service (Amendment) Act 1986 has understandably caused much concern relating to the application of the Health and Safety at Work Act 1974 to hospitals. The NHS managers must remember that their legal obligations can be both civil and criminal.
