Denials of staff privileges face increased antitrust scrutiny

Recent court decisions and statements by federal antitrust officials indicate that hospitals may face increasing scrutiny of their staff privileges decisions. In view of these developments, hospitals must be prepared to defend their decisions from antitrust challenges and should structure their actions to satisfy the remaining defenses to antitrust claims.
