Abstract:
A new law about the rights of the patient is in application since october 2002 and a new law about the personal liability of practitioners in the field of the social security (medical insurance) has come into force since february 2003. Both laws have specific topics but there are links based on the quality of the medical care in the interest and the respect of the patient. The study emphasizes the practical aspect of the new laws and the authors show that they must been studied in the light of the existing doctrine and jurisprudence.
