Abstract:
The evaluation of the percentage detriment to health in the viral hepatitis cases, which reflects the persistent consequences of infection is one of the aims of medicolegal opininioning. The authors have analyzed the medico-legal opinions provided by forensic experts in the Department of Forensic Medicine in Wrocław in the years 1998-2002 and actual literature and have found many differences in the opinions of the forensic experts. This state leads to the situation, when the Court receives excluding opinions made by different experts. The percentage detriment to health can differ in the same case within the range of a few dozen percent. This is caused by the unclear rules of the precentage evaluation of the loss of health in actual legal regulations, which give the experts a vast latitude for interpretation (0-100 %). The authors of this study have shown the rules of opinioning used by experts from the Department of Forensic Medicine in Wrocław and made an attempt to standardize the rules of evaluation of the detriment health in viral hepatitis cases.
