Abstract:
On May 15, the U.S. Supreme Court decided a key question in the struggle to keep health costs affordable: Can employer-based health insurance plans seek a portion of the proceeds when their members have recovered money by suing those responsible for injuries incurred as a result of auto collisions or other accidents? The court held unanimously in the affirmative, thus clarifying an issue that had been disputed among the federal circuit courts and allowing for uniform enforcement of reimbursement and subrogation provisions by health insurance plans.
