Background:

Canada permits 'reasonable' physical punishment of children, unlike 52 other countries.
The Supreme Court of Canada set legal limits on corrective force in 2004.

Purpose of the Study:

To evaluate the effectiveness of the Supreme Court's 2004 limits in protecting children from physical maltreatment.
To determine if substantiated child physical abuse cases exceed the established legal boundaries.

Main Methods:

Operationalized the Supreme Court's limits on physical punishment.
Applied these limits to a provincial sample of substantiated child physical maltreatment cases.

Main Results:

Most substantiated physical abuse cases fell within the court's defined limits.
In over 25% of cases, none of the court's limits were exceeded.
The prevalence of spanking in the home was the strongest predictor of substantiated abuse reports.

Conclusions:

The current legal limits on physical punishment in Canada are insufficient to protect children.
Abolishing physical punishment entirely would offer greater child protection than the existing legal framework.
The findings support policy changes towards the complete prohibition of corporal punishment.
