The Cochlea01:13

The Cochlea

51.4K
The cochlea is a coiled structure in the inner ear that contains hair cells—the sensory receptors of the auditory system. Sound waves are transmitted to the cochlea by small bones attached to the eardrum called the ossicles, which vibrate the oval window that leads to the inner ear. This causes fluid in the chambers of the cochlea to move, vibrating the basilar membrane.

Summary
This summary is machine-generated.

Legal action for cochlear implant (CI) coverage is generally successful, with patients winning most cases against insurance providers. While proceedings can be lengthy, they are usually free and result in the health insurance covering the CI cost.

Area of Science:

  • Otorhinolaryngology
  • Medical Law
  • Health Insurance Law

Background:

  • Indications for cochlear implants (CI) have expanded, including single-sided deafness (SSD), electric acoustic stimulation (EAS), and bilateral CI.
  • Increased CI usage leads to disputes between patients and insurers regarding coverage for surgery and follow-up care.

Purpose of the Study:

  • To provide an overview of German social court judgments concerning cochlear implant (CI) coverage.
  • To determine the advisability and duration of legal proceedings for patients seeking CI insurance coverage.

Main Methods:

  • Searched legal databases for judgments using keywords: "Cochlear," "Cochlea," "Implant," and "Implantat."
  • Included verdicts obtained directly from courts and cited in articles.
  • Reviewed judgments issued between 2003 and 2017.

Main Results:

  • Twelve judgments were analyzed, with patients winning all but one main proceeding.
  • The single lost case involved exceptional circumstances; one patient won the main case despite an initial interim measure denial.
  • Legal proceedings ranged from 1 year and 8 months to 9 years and 5 months.

Conclusions:

  • Pursuing legal action for cochlear implant (CI) coverage is advisable despite the time investment.
  • Social court proceedings are typically free of charge.
  • Statutory health insurance is generally ordered to cover the costs of cochlear implants (CI).
