Abstract:
Chapter 5. State responsibility in public international law, avoidance strategies and future trendsThe international climate regime has not been able to prevent a rise in temperatures that is already being felt and is likely to increase in the future. Therefore, the increasing impacts of climate change lead to questions about their compensation. Although states have developed avoidance strategies, liability issues are arising and will arise with greater acuity, including at the interstate level. In this context, the clarification of the international responsibility of the State in this matter and, hence, of the risks it runs, is important.
