Purpose of the Study:

  • To investigate the perceptions of doctors, patients, and forensic examiners regarding medical disputes and damage identification.
  • To explore a more effective model for medical damage identification to aid in resolving medical disputes.

Main Methods:

  • A questionnaire survey was administered to clinicians, forensic examiners, and patients in Sichuan Province and Chongqing City.
  • Data were collected from April to November 2019 and analyzed using SPSS 22.0 software.

Main Results:

  • A majority of doctors (61.72%) perceive a more tense doctor-patient relationship compared to patients (24.92%).
  • Voluntary consultation and people's mediation are preferred methods for dispute resolution by both doctors and patients.
  • Both groups agree on the necessity of medical damage identification (doctors 66.72%, patients 78.41%) and prefer forensic identification institutions, with a call for joint participation of forensic examiners and doctors.

Conclusions:

  • Medical Association and forensic identification bodies should collaborate to establish unified rules for medical damage identification.
  • Standardization of forensic identification institutions and appraisers, alongside the inclusion of clinical experts, is recommended to enhance the scientific rigor of the process.
