Cloning of Dolly the Sheep01:08

Cloning of Dolly the Sheep

3.4K
The first successfully cloned mammal was Dolly, a sheep, born on 5th July 1996 at Roslin Institute, Scotland. The cloned sheep was named after the American singer Dolly Parton. Dolly lived for seven years and died of respiratory complications, which is speculated to be due to the actual age of her DNA. Because the DNA in cloned cells belongs to an older individual,  the cloned individual’s life expectancy may be affected. Indeed, analysis of Dolly’s DNA revealed shorter...

Summary

This study examines the legal status of animals in research, proposing that nonhuman animals could gain legal personhood for enhanced protections under the Animal Welfare Act.

Area of Science:

  • Legal Studies
  • Animal Law
  • Bioethics

Background:

  • Nonhuman animals in biomedical research currently lack personal legal rights.
  • Existing legal frameworks do not recognize animals as legal persons.
  • This status limits their protection under current legislation.

Purpose of the Study:

  • To explore the definition and implications of legal personhood.
  • To assess the feasibility of granting legal personhood to nonhuman animals.
  • To propose enhanced legal protections for research animals.

Main Methods:

  • Analysis of legal personhood definitions.
  • Review of animal welfare legislation, specifically the Animal Welfare Act.
  • Philosophical and legal argumentation for extending rights.

Main Results:

  • Legal personhood is a construct that can be extended.
  • Current legal status of research animals is inadequate for robust protection.
  • Extending personhood offers a viable pathway for improved welfare.

Conclusions:

  • Nonhuman animals can be conceptualized as legal persons.
  • Granting legal personhood would significantly improve protections for animals in biomedical research.
  • This legal shift necessitates a re-evaluation of the Animal Welfare Act.
