Summary

This study found that linking compensation to functional deficits and patient rehabilitation needs improves financial fairness in injury claims. A multidisciplinary approach ensures more appropriate compensation for biological damage.

Background:

Accidents and injuries are a major cause of disability in young people.
The Italian legal-insurance system uses international methods for evaluating biological damage.
There's a need for innovative medical-legal systems to ensure fair financial compensation.

Purpose of the Study:

To investigate the correlation between rehabilitation assessment-based compensation and patient functional deficits.
To develop a more accurate medical-legal evaluation system for biological damage.

Main Methods:

Inclusion of clinically stable patients able to communicate in Italian with ongoing litigation.
Multidisciplinary evaluation including forensic physicians, physiotherapists, and occupational therapists.
Assessment of functional impairment using standardized scales (DASH, BERG, KOOS, LEFS-I, TSK, FSS, SF-36).

Main Results:

Significant correlations found between functional deficits, life expectancy, and proposed compensation.
Rehabilitation interventions like hydrotherapy and motor rehabilitation showed links to compensation.
Validated scales demonstrated positive correlations with overall functional deficit and total compensation.

Conclusions:

Integrated, multidisciplinary evaluations are recommended for future compensation practices.
Compensation should consider residual functional damage alongside pathology severity.
This approach enhances the appropriateness of financial settlements for biological damage.
