Abstract:
This article discusses the prohibition of surrogacy in Israeli subordinate legislation and the illegality and unconstitutionality of this prohibition. It reviews the recommendations of a public committee appointed to investigate the practice of surrogacy and the applicability of adoption laws to children born of surrogate arrangements. In view of the growing demand for access to surrogacy and the need to resolve the problem of childlessness in Israel, the author recommends the enactment of primary legislation to regulate the matter.
