Summary

Physicians must maintain patient confidentiality to build trust. However, they may breach confidentiality to prevent harm, disclosing only necessary information to authorized individuals, ideally after discussing with the patient.

Situations arise where breaching confidentiality is necessary and legally permissible.
Provincial legislation dictates specific circumstances for authorized disclosure without patient consent.

Findings:

The duty to warn can supersede the duty to maintain confidentiality when there is a risk of harm.
