Sus antecedentes:

  • La Ley de Seguridad de Ingresos de Jubilación de los Empleados (ERISA) de 1974 rige los planes de salud y pensiones patrocinados por los empleadores de los Estados Unidos.
  • Las Organizaciones de Atención Gestionada (MCO) operan dentro del complejo marco regulatorio establecido por ERISA.
  • La autonomía profesional de los médicos y la toma de decisiones clínicas se ven significativamente afectadas por las disposiciones de ERISA.

Objetivo del estudio:

  • Aclarar las disposiciones centrales de ERISA y su influencia en la prestación de atención médica dentro de las OCM.
  • Analizar las tendencias de litigios de ERISA con respecto a la responsabilidad del médico, la gestión de la utilización, las iniciativas estatales y la compensación.
  • Evaluar cómo las interpretaciones judiciales de ERISA afectan la autonomía del médico y el juicio clínico.

Conclusiones:
