Sus antecedentes:

  • El Reglamento sobre el acceso a los datos financieros (FIDA) tiene por objeto impulsar la competencia mediante la ampliación de los derechos de portabilidad de los datos.
  • Las regulaciones existentes como la PSD2 se han enfrentado a desafíos con la interoperabilidad y la confianza del consumidor.

Objetivo del estudio:

  • Analizar los riesgos de derecho de la competencia asociados con el marco de gobernanza de la FIDA.
  • Evaluar si el gobierno de la FIDA puede prevenir riesgos sin normas sustantivas obligatorias.

Principales métodos:

  • Análisis del marco de gobernanza del FIDA (artículo 10) en relación con los principios del Derecho de la competencia de la UE (artículo 101 del TFUE).
  • Comparación con las cuestiones de competencia observadas en el marco de la DSP2.

Principales resultados:

  • El marco de gobernanza de la FIDA se alinea con las directrices del derecho de la competencia, pero carece de normas sustantivas obligatorias.
  • La ausencia de normas conlleva el riesgo de fallos de interoperabilidad, reducción de los incentivos y reducción de la aceptación por parte de los consumidores, lo que refleja los problemas de la PSD2.

Conclusiones:
