    Resumen

    Incluso si un proceso de contratación se basa en el mérito, puede no garantizar la equidad si los solicitantes carecen de oportunidades. Este estudio defiende la acción afirmativa en la justicia penal, sugiriendo indulgencia para los delincuentes que carecen de oportunidades justas para evitar el crimen.

    Área de la Ciencia:

    • Estudios socio-jurídicos
    • Ética de la justicia penal
    • Las políticas públicas

    Sus antecedentes:

    • La contratación basada en el mérito puede no garantizar una equidad sustancial si los candidatos no tienen la misma oportunidad de desarrollar sus cualificaciones.
    • La equidad formal en la sentencia penal (no discriminatoria) puede ocultar la injusticia sustancial debido a las oportunidades limitadas de los delincuentes desfavorecidos.

    Objetivo del estudio:

    • Proponer un concepto análogo a la acción afirmativa para la justicia penal.
    • Para argumentar por la clemencia en la sentencia para los delincuentes que carecían de una oportunidad justa para evitar el comportamiento criminal.

    Principales métodos:

    • Análisis conceptual que establece paralelismos entre los sistemas de empleo y de justicia penal.
    • Argumentación ética que defiende la aplicación de los principios de la "acción afirmativa" en la sentencia.
