Abstract:
The Department's Claims Collection regulations at 45 CFR Part 30 implement the Federal Claims Collection Act of 1966 and the implementing Federal Claims Collection standards issued by the Department of Justice and the General Accounting Office. This final rule would amend the regulation to implement the Debt Collection Act of 1982 Amendments to the Act of 1966, as these Amendments were interpreted in revisions to the Federal Claims Collection Standards and new guidelines issued by the Office of Personnel Management. The rule would also establish procedures for the exercise of the Department's authority to collect and dispose of debts under the common law. These procedures are not intended to supersede or preempt, but rather should complement, procedures which may now exist or may later be promulgated for the collection and disposition of debts arising under particular programs administered by the Department.
