Abstract:
As the number of health related lawsuits increases, the chance of clinical nurse specialists appearing in court increases. Clinical nurse specialists must realize that the key to winning in the courtroom may not depend on a point of law but rather on whom the jury views as the most trustworthy witness. The key is credibility! This article provides information that will enable clinical nurse specialists to develop credibility with the jury. It addresses such issues as what nurses' rights and responsibilities include, when it is appropriate to address the judge, how to keep a lawyer "honest," and specific ways a nurse can prepare to give testimony, including the deposition.
