Area of Science:

  • Dental jurisprudence
  • Clinical dentistry
  • Risk management in healthcare

Background:

  • Malpractice claims against dentists are a significant concern in healthcare.
  • The Danish Dental Complaint Boards (DCB) handle numerous cases annually.
  • Endodontic treatments are complex and may present unique challenges leading to claims.

Purpose of the Study:

  • To analyze the reasons and outcomes of dental malpractice claims in Denmark from 1995-2004.
  • To specifically investigate endodontic malpractice claims.
  • To test hypotheses regarding the frequency, causes, and demographics of endodontic claims.

Main Methods:

  • Retrospective analysis of 3611 malpractice claims filed with the DCB (1995-2004).
  • Classification of claim reasons into 14 categories, with sub-categorization for endodontic cases.

  • Demographic analysis of dentists and patients involved in endodontic claims.
  • Main Results:

    • 43% of all claims resulted in a guilty verdict for the dentist.
    • Endodontic treatment was the second most frequent claim type (13.7%) after crown & bridge (23%).
    • Technical complications or incorrect endodontic treatment (28.4%) were primary reasons, including poor root filling quality, paraformaldehyde use, and instrument fracture. Male dentists and female patients were overrepresented.

    Conclusions:

    • Endodontic malpractice claims are relatively frequent in Denmark.
    • Technical shortcomings in root canal procedures are a major driver of patient complaints.
    • Gender disparities in claims suggest potential communication issues influencing liability.
