We would like to see clear eligibility criteria that are not open to challenge on Coughlan or Grogan judgement grounds. The tool itself should be simple with unambiguous language to avoid confusion with other assessments such as the Registered Nurse Contribution to Care determination (if it still exists then!). It is important that new criteria take account other funding mechanisms such as the Mental Health Act Section 28a, section 3, forensic sections 37/41. We need criteria that cover all client groups equally including those with learning disabilities and mental health issues, and all ages from 18 upwards.
