Abstract:
The value of the TARMED point is set by contract between insurers and service providers (tariff agreements), with state intervention limited, in theory, to ensure legal compliance. The state also has subsidiary powers in the absence of tariff. A recent ruling by the Federal Administrative Court highlights the framework tariff, an asset for doctors' associations in tariff negotiations. This tariff, applicable for at least one year in the absence of an agreement, provides for a range of tariffs around the approved point value, allowing billing at a higher value than in the previous year. This instrument serves as an important leverage for doctors, while limiting state intervention. Its compulsory application has now been confirmed.
