Medical image sharing 2026 best practice laws, legislation and regional variance

The sharing of medical imaging for educational purposes is a valuable practice among healthcare professionals. However, it also presents increasing legal and ethical challenges in an evolving digital environment. In June 2025, the European Union General Data Protection Regulation (GDPR) was superseded with the new United Kingdom (UK) GDPR. In this article, we aim to highlight significant updates to UK data protection taking effect and how there is a renewed need for healthcare professionals to understand how to safely share patient imaging. In this article, we examine whether anonymisation alone remains sufficient to ensure legal compliance. We review current guidance from professional and regulatory bodies and compare approaches across different regions. We analyse case examples that demonstrate how modern regulations change how imaging should be anonymised including residual metadata, contextual information, and distinctive features alongside the use of explicit patient consent and broad consent. We will also analyse the expansion of powers for regulatory bodies of personal data and discuss how this could impact healthcare organisations and educators. We conclude in this article that anonymisation, while necessary, is frequently insufficient in isolation and that a combined approach incorporating thorough de-identification practices, informed consent, appropriate usage of imaging in teaching and appropriate methodology of sharing patient imaging may be required. Through the analysis of the legal changes, ethical frameworks set up by institutions and practical steps that could be followed to ensure anonymisation and consent are intact, we aim to provide possible updates for frameworks to help healthcare institutions and professionals balance educational value with patient confidentiality and public trust.
