[The programmed physician: the obligation to give explanatory instruction in pediatric surgery (author's transl)]
Abstract:
Physicians and judges do not often have exactly the same conception of instructive explanation. Nevertheless, the pre-operative instruction of parents and persons under age has to follow the principles set by the jurisdiction. Compared to adult surgery, conditions are less complicated with pediatric patients. Nevertheless there is an increasing number of claims for damages, and liability proceedings, caused to some extent by incomplete knowledge of the legal situation. Proposals for improvement and prophylaxis are offered in this article.
